Private to Public Street Conversion Process
In some neighborhoods, an existing private street may begin functioning as a public roadway. This may occur when the road is used to connect to a new subdivision or provides access to a public facility. When this occurs, the homeowners association can request that the City evaluate the street for potential public dedication.
Park City’s Private to Public Street Process outlines the steps an HOA must follow to submit this request and to help determine whether the roadway meets City standards for acceptance.
First Step
- Make an appointment with the City Engineer to discuss if the street meets City Standards and if the street meets City Standards then;
- Submit a formal request for the City to dedicate the street. This request should document the following at a minimum:
- How the private street is functioning as a public street;
- When the functionality of the private street changed;
- Length and width of roadway that is being requested to convert to public; and
- Roadway maintenance history.
Second Step
- The City Engineer will evaluate the provided information and reach out if additional information is necessary. If the request meets preliminary requirements for potential public dedication, City Engineering will take the request for dedication to City Council. If the City Council approves the request then the applicant(s) will need to go through a formal re-platting of subdivision from private to public.
